Products Liability

Products Liability Cases & Safety Concerns

When we use tools, machinery and other products in our day-to-day lives, we expect to be able to operate them safely. When a product you use for work or personal activities malfunctions, the results can be catastrophic. Permanent disability, disfigurement or even death can result.

At Engle, Kauffman & VanHorn, P.C., our attorneys represent plaintiffs in a variety of products liability cases. They understand the importance of carefully researching the accident, gathering crucial medical evidence to validate your claim, and properly calculating damages so that your medical, rehabilitative, vocational and financial needs are completely covered. More than that, however, they appreciate their role as zealous advocates for your case, so that you can focus on healing and rebuilding your life.

What Types Of Products Can Fail?

Almost any manufactured or constructed product can malfunction. Some that are unfortunately common in central Pennsylvania include:

  • Tractors — Farmers and their employees can be catastrophically injured in rollover accidents or incidents in which brakes fail.
  • Ladders — Homeowners, farmers and tradespeople can be paralyzed, suffer head or spinal cord injuries, or worse when ladders fail to support them when working high above the ground.
  • Power tools — Eye, hand and facial injuries can be caused by saws, drills or sanders that suddenly malfunction.
  • Appliances — Electrical shock and cutting injuries are just two types of accidents that can injure someone using an appliance.

Limits To Products Liability Claims

It is important to note that Pennsylvania has a statute of limitations of two years for filing personal injury claims and that it follows a “modified comparative negligence rule.” That means that if you are found to be partially at fault for the accident causing your injury, your damages will be reduced by the percentage for which you are found liable.
